Creston Police: Two arrested on warrants

Walter I. Malacara, 35, of Lenox, was taken into custody 11:35 a.m. July 9, at the Union County Law Enforcement Center on a Union County warrant for the charge of failure to appear on the original charge of OWI, second offense.

According to Union County District Court documents Malacara was ordered to appear March 14 for a pretrial conference on the original charge and did not.

Malacara was transported to the Union County Jail and held on $2,000 cash only bond.

Heather M. Davis, 42, of Lorimor, was taken into custody 5:57 p.m. July 9, in the 600 block of New York Avenue on a Union County warrant for the charge of failure to comply with conditions of pretrial release. She was additionally charged with providing false identification and harassment, first degree.

At approximately 5:49 p.m. a 2004 Ford F250 was stopped by police. While attempting to identify a female backseat passenger, it became apparent she was giving officers a fake name and date of birth. After confirming the passengers identity to be that of Davis, she was taken into custody on a Union County warrant. During the arrest, Davis made told an officer on scene she was going to shoot and kill him.

According to Union County District Court documents, Davis was granted pretrial release April 21, 2023, after being taken into custody and charged with 12 counts of dominion or control of a firearm or offensive weapon by a felon, five counts of controlled substance violation and failure to affix drug tax stamp. In order to be released, Davis signed an agreement to comply with any and all terms and conditions imposed by the Department of Correctional Services while being supervised on Pretrial Release Level 3.

The Pretrial Release Division of the Fifth Judicial District, Department of Correctional Services, alleges Davis violated the terms of these release conditions by failing to report as directed and maintain contact with her probation officer and failure to successfully complete substance abuse treatment.

Davis was transported to the Clarke County Jail and held on $25,000 cash only bond on the warrant charge and $2,300 cash or surety bond for the new charges.
