Alex R. Cunningham, 34, of Creston, was taken into custody 12 a.m. June 15, in the 1200 block of County Club Drive on the charge of violation of a no contact order.
According to a Creston Police report, at approximately 10:57 p.m. June 14, Cunningham was reported for being on the property of a male who has a no contact order against Cunningham.
The protected party stated Cunningham was seen on his property several times, looking in the windows and looking over a privacy fence.
When officers arrived they observed Cunningham walking away from the residence. Cunningham made statements indicating he had stepped off the sidewalk by the protected party’s house and looked in the window. He also admitted to knowing there was a court order in place and he was not supposed to be near the residence.
Cunningham was transported to the Union County Jail and held on $1,000 cash only bond.

David J. Rathe, 60, of Creston, was taken into custody 1:41 a.m. June 14, at Maple and Adams streets on the charge of OWI, first offense.
According to a Creston Police report, at approximately 1:18 a.m. a 2006 Dodge Ram was observed turning north off of Montgomery Street onto Walnut Street. As the truck turned it struck the curb on the southwest side of the intersection. The truck then made a wide turn west onto Adams Street, with both driver’s side tires crossing the centerline.
A traffic stop was conducted and contact was made with the driver, identified as Rathe, and the odor of an alcoholic beverage was immediately detected coming from his person. Rathe was observed to have bloodshot, watery eyes and delayed, slurred speech. When asked for his driver’s license, he attempted to give officers a credit card.
Rathe admitted to having five beers before being stopped. He consented to field sobriety testing and showed numerous validated clues of impairment. He also consented to a PBT which indicated his BrAC to be above .08%.
Rathe was transported to the Union County Law Enforcement Center where he consented to provide a breath specimen for chemical testing. The result indicated Rathe to have a BAC of .165%.
Rathe was transported to the Union County Jail where he was released from after posting $1,000 cash or surety bond.

Damien N. Beard, 22, of Afton, was taken into custody 12:04 p.m. June 14, at Rainbow Park on the charges of disorderly conduct – fighting or violent behavior.
According to a Creston Police report, at approximately 11:45 a.m. Beard was involved in a fist fight while at a birthday party at the park. The altercation was reported by multiple witnesses and recorded on video.
Beard was transported to the Union County Jail where he was released from on his own recognizance on a promise to appear.

John D. Foster, 40, of Creston, was taken into custody 12:45 p.m. June 14, at Rainbow Park on the charges of disorderly conduct - fighting or violent behavior and interference with official acts.
According to a Creston Police report, at approximately 11:45 a.m. Foster was involved in a fist fight at the park. While being transported to the Union County Law Enforcement Center, Foster slipped his handcuffs and continued to resist while being escorted to the jail.
Foster was transported to the Union County Jail where he was released from after posting $600 cash or surety bond.

Ely L. Will, 32, of Clearfield, was taken into custody 2:12 p.m. June 15, at Fremont and Oak streets on the charges of driving while barred, possession of a controlled substance with intent to deliver and failure to affix a drug tax stamp.
According to a Creston Police report, at approximately 2:12 p.m. Will was observed driving a 1999 Dodge Dakota on Fremont Street. Officers confirmed his driver’s license to be barred and then conducted a traffic stop.
During the stop, the Stuart Police Department K9 was contacted for assistance. The K9 arrived at the scene and was deployed for a free air sniff around the truck and gave a positive alert to the presence of the odor of narcotics.
A probable cause search was conducted and a magnetic box was located behind the backseat on the floorboard. The box contained approximately 59 grams of a white crystalline substance which field tested positive for methamphetamine.
Will was transported to the Union County Jail and held without bond until seen by a judge.

Paul W. Daniels, 41, of Creston, was taken into custody 5:08 p.m. June 15, at McKinley Park on two Union County warrants, the first for the charges of domestic abuse assault - impeding air/blood flow causing bodily injury, harassment, first degree; harassment, second degree and two counts of domestic abuse assault, third or subsequent offense. The second warrant was for the charge of violation of probation. Daniels was additionally charged with possession of a controlled substance - marijuana, first offense.
According to Creston Police reports, at approximately 10:30 p.m. Sept. 1, Daniels reportedly was irritated with a female victim for attempting to leave a Manor Drive residence. Daniels stopped the victim’s car and got inside where they had an argument. During the argument Daniels punched the victim in the face several times in front of a child who was also in the car. After the assault, Daniels had the victim go inside the residence.
The victim provided photos of the incident and witnesses attested to seeing the victim’s injuries and that the victim had admitted to being assaulted by Daniels.
At approximately 8 p.m. Dec. 29, Daniels, who was reportedly intoxicated, started a verbal argument with the victim about past incidents. Daniels became angry and got in the victim’s face. When the victim told Daniels to get out of her face, he pushed her onto the couch and shoved her face into the couch before she was able to move away from him. He then began strangling the victim and punching and elbowing her in the face. The victim was able to stop the assault by distracting Daniels but he continued to degrade her until he went to sleep.
The victim took photos of her injuries, which showed extensive injuries to her face and bruising on her neck.
At approximately 7 p.m. April 25, Daniels went to a friend’s and became intoxicated. The victim told Daniels not to come to the residence due to his intoxication and locked the doors and attempted to barricade the back door with a refrigerator. Daniels forced his way into the back door and pushed the victim into a bedroom before punching her in the face and knocking off her glasses. A child in the room told him to stop.
Daniels followed the victim into the bathroom and living room and continued to punch and kick her. Daniels refused to allow the victim to use the bathroom and forced her to urinate herself. Daniels then used a stand for a child’s toy to hit the victim in the head which caused a laceration and caused the victim to feel woozy. Daniels began degrading the victim while a child sat on his lap. When Daniels was walking to the kitchen, he said, “I swear I’m going to f**k*ing kill her.”
The victim provided photos of her injuries which showed extensive bruising and injuries. A witness also stated they observed bruising to the victim after the assault.
At approximately 10:30 p.m. May 12, Daniels and the victim got in an argument while the victim was holding an infant. Daniels told the victim is she didn’t stop lying to him he was going to punch around the infant.
According to an Iowa Judicial District Department of Correctional Services report, on Dec. 15, 2023, Daniels received a suspended sentence including one year of probation after being convicted of domestic abuse assault causing bodily injury in Union County.
Daniels violated the terms of his probation by failing to regularly attend the court ordered Iowa Domestic Abuse Program, failing to make consistent payments toward his supervision and court fees and by incurring new charges in Union County.
While being taken into custody for the warrants, a search of Daniels’ person was completed. Officers located a vape pen with a cartridge containing marijuana in his pocket. The item also field tested positive for marijuana.
Daniels was transported to the Union County Jail and held without bond until seen by the judge on the warrant charges and $1,000 cash or surety on the new charge.
